Limited Warranty

GovComm, Inc. (GovComm) products are manufactured from new parts and components in accordance with industry-standard practices. GovComm warrants that its hardware products will be free from defects in materials and workmanship. Our warranty protects customers against equipment failure, defects and/or failure in design, materials and compliance with project requirements.

This limited warranty applies only to the original end user customer of the product for so long as the original end-user customer owns and has fully paid for the product. This limited warranty is non-transferable.

Damage due to shipping the products to you is covered under this limited warranty. Otherwise, this limited warranty does not cover damage due to external causes, including but not limited to: accident, abuse, misuse, modifications, problems with electrical power, servicing not authorized by GovComm, usage not in accordance with product instructions, failure to perform required preventive maintenance, and problems caused by use of parts and components not supplied by GovComm.

This limited warranty does not cover any software, external devices, accessories or parts added (except as specifically noted); to a GovComm system after the system is shipped from GovComm. Peripherals that are GovComm branded or that are included on GovComm’s standard price list are covered under this limited warranty.

During the warranty period beginning on the invoice date, GovComm will repair or replace products covered under this limited warranty that are returned to GovComm’s facility. To request limited warranty service, you must contact GovComm’s Customer Technical Support within the limited warranty period. Refer to this Limited Warranty,www.GovComm.us or your product documentation to find the appropriate telephone number or email address for obtaining warranty assistance. If limited warranty service is required, GovComm will issue a Return Material Authorization (RMA) Number. You must ship the products back to GovComm in its original or equivalent packaging, prepay shipping charges, and insure the shipment or accept the risk of loss or damage during shipment. GovComm will ship the repaired or replacement products to you freight prepaid if you use an address in the continental United States, where applicable. Shipments to other locations will be made freight collect.

NOTE: Before you ship the product(s) to GovComm, back up any data and remove removable media (such as SD cards). GovComm does not accept liability for lost data.

GovComm owns all parts removed from repaired products. GovComm uses new and reconditioned parts made by various manufacturers in performing limited warranty repairs and building replacement products. If GovComm repairs or replaces a product, its limited warranty term is not extended.

This limited warranty gives you specific legal rights, and you may also have other rights that vary from state to state (or jurisdiction to jurisdiction). govcomm’s responsibility for malfunctions and defects in hardware is limited to repair and replacement as set forth in this limited warranty statement. all express and implied warranties for the product, including but not limited to any implied warranties of and conditions of merchantability and fitness for a particular purpose, are limited in duration to the limited warranty period set forth above and no warranties, whether express or implied, will apply after such period. some states (or jurisdictions) do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.

Govcomm does not accept liability beyond the remedies set forth in this limited warranty statement or liability for incidental or consequential damages, including without limitation any liability for products not being available for use or for lost data or software. some states (or jurisdictions) do not allow the exclusion or limitation of incidental or consequential damages, so the above exclusion or limitation may not apply to you.

The foregoing is the complete warranty for govcomm products and supersedes all other warranties and representations, whether oral or written. except as expressly set forth herein, no other warranties are made with respect to govcomm products and govcomm expressly disclaims all warranties not stated herein, including, to the extent permitted by applicable law, any warranty that may exist under national, state, provincial or local law including but not limited to any implied warranty of non-infringement, merchantability or fitness for a particular purpose. all warranties, whether express or implied, are limited to the periods of time set forth above. some states or other jurisdictions do not allow the exclusion of implied warranties or limitations on how long an implied warranty lasts, so the above limitations may not apply to you.

These provisions apply to GovComm’s limited warranty only. For provisions of any on-site service contract covering your system, refer to the on-site service contract you may have purchased separately.
